The debate over the extraordinary extension of rental contracts and its legal consequences is currently at the center of the real estate market’s attention. Carlos Muñoz Juanpere, partner at CIM Tax & Legal, has shared his professional analysis in an article published in elEconomista.es, titled "The decree on rentals expires this Tuesday and will open a scenario of uncertainty".

Royal Decree-Law 8/2026, approved by the Council of Ministers on March 20 and published the same day in the Official State Gazette (BOE), establishes an extraordinary extension of up to two years for residential lease agreements expiring before December 31, 2027, while also limiting the annual rent update to 2%. The regulation entered into force immediately, but its validity is subject to parliamentary ratification within the constitutionally established 30-day period. With PP, Vox and Junts opposing it, its repeal is practically certain, opening a legally complex scenario for nearly three million people.

The key issue concerning the sector is what will happen to the extensions already requested during the period in which the decree has been in force. Carlos Muñoz aligns with other specialists consulted by the publication and considers that the non-ratification of the RDL in Congress "would have repealing effects, but not nullifying ones". In other words, the decree would cease to have effects going forward, but would not necessarily retroactively invalidate the rights already exercised by tenants during the time it has been in force.

Carlos also warns that this way of legislating will increase litigation and legal uncertainty for landlords and tenants, in a scenario that the Minister of Housing herself has described as "unprecedented".
