CIM Perspective: “Prudence should not be fiscally penalized in family businesses”

The newspaper Expansión has published an interview with Maria Ravetllat, tax manager at our firm, together with Emma S. Corretger and Carlos Muñoz, partners. In the interview, the three experts analyze the main tax challenges faced by family businesses and reflect on the impact of the current criteria applied by the Tax Administration.

During the conversation, CIM’s representatives highlight that the lack of reasoning behind many penalties imposed by the Treasury is being corrected by the courts, although few taxpayers decide to appeal. “Penalties are imposed left and right without any review, and that’s where the Treasury makes a mistake, as it often forgets to justify many of them,” notes Carlos Muñoz.

For her part, Maria Ravetllat recalls that the presumption of innocence is a fundamental principle recognized by both the Constitution and the General Tax Law, and that the Administration cannot assume a taxpayer’s guilt without proper justification.

Regarding the taxation of family businesses, Emma S. Corretger points out that the current treatment of cash surpluses penalizes financial prudence.

The experts also analyze the recent monitoring activity by the Tax Agency, the regulatory complexity surrounding family businesses, and the importance of ensuring that audits and inspections are properly justified to avoid unnecessary litigation.
