
The Treasury speeds up Wealth Tax resolutions to avoid refunds

The newspaper elEconomista has published an article titled “The Treasury speeds up the resolution of appeals against the Wealth Tax to avoid refunds”, written by journalist Eva Díaz, featuring contributions from Carlos Muñoz and Emma S. Corretger, partners at CIM Tax & Legal.
In this publication, both experts analyze how the Tax Administration is rapidly resolving appeals and requests for correction related to the Wealth Tax, which has been challenged before the Constitutional Court (TC) since 2021, with the aim of securing final decisions before a possible Constitutional Court ruling favorable to taxpayers.
As Carlos Muñoz explains, “in recent months the Administration has been resolving appeals at an unprecedented speed; in some cases, the response has arrived in just fifteen days.” This pace, he adds, reflects the goal of ensuring that cases become final before a potential Constitutional Court ruling that could annul the tax and force refunds to taxpayers.
For her part, Emma S. Corretger highlights the impact of this situation on legal certainty: “There is no article in the Law on Contentious-Administrative Jurisdiction that allows the suspension of proceedings pending before the Constitutional Court, which creates uncertainty for taxpayers, the Administration, and the courts.”
The article also points out that some High Courts of Justice are choosing to suspend proceedings pending the TC’s ruling, while others continue resolving appeals, creating a disparity of criteria and a climate of legal uncertainty for both taxpayers and the Administration.
The decision of the Constitutional Court, expected in 2026, will be key to determining the future of the Wealth Tax and any potential refunds arising from its possible annulment.
